The material accessed on or through this website, including any ground rules, methodology or other information relating to the TSRR Rates (the "Material") and the TSRR Rates itself are governed by the terms and conditions set out below. The TSRR Rates and related Material is: (i) published for internal evaluation purposes only; (ii) not to be relied upon or otherwise used by you as a benchmark in financial instruments and/or contracts or as a measure of the performance of an investment fund, or for the purposes of any issuance, valuation or pricing (including in respect of other financial products) or any other commercial purpose or use whatsoever; (iii) based on a set of data which may be incomplete or evolve, and is further based on methodology that is evolving and which may change without notice (at FTSE's sole discretion); (iv) provided “as-is”, with no commitment or guarantee as to accuracy, timeliness or completeness. All copyright, database rights and other proprietary rights in the TSRR Rates and the Material are and shall remain the property of FTSE. The TSRR Rates are indicative rates and are not, and are not intended to be, used (as “use” is set out in article 3(1)(7) of Regulation (EU) 2016/1011 of the European Parliament and the Council of 8 June 2016 on indices used as benchmarks in financial instruments and financial contracts or to measure the performance of investment funds (the “European Benchmark Regulation”)) as a benchmark in the European Union and accordingly, the European Benchmark Regulation does not apply to the TSRR Rates. Consequently: (i) supervised entities within the European Union are not permitted to use the TSRR Rates as a benchmark as set out in article 3(1)(7) of the European Benchmark Regulation; (ii) FTSE International Limited is not the benchmark administrator (as defined in article 3(1)(6) of the European Benchmark Regulation) of the TSRR Rates.
